In compliance with Section 13 of Legislative Decree n. 196 of 30th June 2003 (Data Protection Code), we inform our website users that:
our servers automatically record the following information sent by users’ browser:
•	Internet domain and IP address
•	type of browser and Operating System
•	date, time and permanence on site
•	pages visited
•	eventual search engines you have accessed our website from
Such information does not identify anyone individually.

The automatically collected information can be processed by Data Controller,  PHITOGEN HOLDING Spa, for the following purposes:
•	in case of suspected current law breaches 
•	for statistical purposes
•	for navigation and website content improvement

Personal and/or Company Data provided by the user when filling out forms found on the WWW.PHITOGENSPA.IT website, and subsequently authorized by the user in accordance with Legislative Decree 196/2003, are protected by Data Controller and are processed for the purposes, among which: providing information requested by the user, or contacting the user regarding services provided or eventual promotional information and/or price quotes.

1.	DATA PROCESSING PURPOSES
We intend to process the Data you submit us for the following purposes:
a) providing you the service requested
b) satisfying of administrative and accountancy purposes as provided for by law, since strictly connected to contracting regulations;
c) sending of marketing information, promotional initiatives, sending of advertising material or newsletters when requested by the user;

2.	MODALITIES OF PROCESSING
Pursuant to Section 11, paragraph 1 of Legislative Decree n 196 of 30th June 2003, the Data shall be processed manually and by means of information and telecommunication instruments, following the logic strictly related to the purposes the Data were collected for, and, in any way guaranteeing Data security and confidentiality.

3.	THE OPTIONAL CHARACTER OF DATA PROVIDING AND THE CONSEQUENCES OF AN EVENTUAL DECLINE TO REPLY
The Data providing is optional. An eventual decline to provide such Data for purposes as per paragraph a) and b) of section 1 above, could cause a partial or a null service providing; as to paragraph c) the Data providing is optional and an eventual decline of consent does not imply any consequence.

4.	COMMUNICATION AND DISSEMINATION 
The personal Data may be communicated to third parties, such as persons in charge of Data processing or Data processors, professional offices or entities if properly involved with the fulfilment of our business activity. Moreover, the personal Data may be communicated to third parties for business purposes when requested by law and legal and/or fiscal norms.
Personal Data shall not be communicated to subjects other than those specified above, nor shall be disclosed.

5.	IDENTIFICATION DATA CONCERNING DATA CONTROLLER, DATA PROCESSOR AND THE REPRESENATIVE OF DATA CONTROLLER AS DESIGNATED IN THE STATE’S TERRITORY
We inform you that Data Controller is Phitogen Holding SpA in the person of its Legal Representative, with registered office located in San Benedetto del Tronto (AP) Via Val Tiberina 140/P, and that Data Processor is Giovanni Gabrielli, with address for service at the registered office of the writer in compliance with dispositions referred to in Legislative Decree 196/2003. The communications for the exercise of Data Subject rights, as per Section 7 of Legislative Decree 196/2003, must be forwarded to the mentioned registered office by registered letter with return receipt. A complete list of subjects the Data might be communicated to, is also available at the office mentioned above.

6. DATA SUBJECT’S RIGHTS
In the capacity of Data Subject you shall be able to exercise your rights in any moment, as per Section 7 of Legislative Decree 196/2003, which is reproduced below for your convenience:

1.	A data subject shall have the right to obtain information as to whether or not personal Data concerning them exist, regardless of their being already recorded, and communication of such data in intelligible form.
2.	A data subject shall have the right to be informed:

a)	Of the source of personal Data;
b)	Of the purposes and methods of the processing;
c)	Of the logic applied to the processing, if the latter is carried out with the help of electronic means;
d)	Of the identification Data concerning Data Controller, Data Processors and the Representative designated as per Section 5(2);
e)	Of the entities or categories of entity whom or which the personal Data may be communicated to, and who or which may get to know said Data in their capacity as designated representative(s) in the State’s territory, data processor(s) or person(s) in charge of the processing.
3.	A data subject shall have the right to obtain:
a)	Updating, rectification or, where interested therein, integration of the data;
b)	Erasure, anonymization or blocking of Data that have been processed unlawfully, including Data the retention of which in unnecessary for the purposes they have been collected and subsequently processed for;
c)	Certification to the effect that the operations as per letters a) and b) have been notified, as also related to their contents, to the entities whom or which the data were communicated or disseminated to, unless this requirement proves impossible or involves a manifestly disproportionate effort compared with the right that is to be protected.
4.	A data subject shall have the right to object , in whole or in part,
a)	on legitimate grounds, to the processing of personal Data concerning  them, even though they are relevant to the purpose of the collection;
b)	to the processing of personal Data concerning them, where it is carried out for the purpose of sending advertising  materials or direct selling or else for the performance of market or commercial communication surveys.

7. COMPETENT COURT
Whenever quarrels arise between the user and Data Controller or other subjects that have collaborated, collaborate or will collaborate with PHITOGEN HOLDING Spa, the user accepts the jurisdiction of Italian State, and in any case, the enforcement of Italian law, independently from the user’s domicile or seat. The competent court is the court of ASCOLI PICENO.

By sending in this Form, the Doctor undertakes to use the credentials in an exclusively personal way and to keep them reserved and not to communicate them to anyone else.
